General Product Safety Regulation (GPSR)
What is the GPSR?
The EU General Product Safety Regulation (GPSR) came into force on 14 December 2024. In order to protect consumers of products being sold, the Regulation requires certain provisions to be in place for all non-food products of non-EU origin being sold into EU nations and Northern Ireland. There are only limited exceptions for certain categories of products. Vintage watches, clocks, straps and parts do not fall into any of these categories.
The regulation sets out clear and specific provisions relating to Manufacturers, Distributors and Providers of Online Marketplaces. There is no specific text within the Regulation that covers independent traders/retailers with an online shop, and no specific provisions relating to the sale of vintage items no longer in production.
In summary, the provisions include requirements for:
A Product Safety Sheet, including the manufacturer's address and contact details, to be available for every product sold, no matter how big or small, no matter what the value, no matter when it was manufactured or by whom, even if the manufacturer is unknown (e.g. unbranded vintage item) or if the manufacturer no longer exists.
User instructions and manual to be provided for every product.
The above to be provided in the language of each country into which the products are being made available for sale.
An EU safety representative to be assigned, located within the EU, as a contact for safety issues and GPSR compliance, with electronic contact details provided.
